Agreement and Understanding

I have approached the Indian Food Solutions through this website to get in touch with the professional for my personal need.

Indian Food Solutions is merely acting as intermediary between the professional and myself.

Limitations of Liability

• Indian Food Solutions is not responsible or liable for the data provided, shared by me or the professional.
• I understand that the Indian Food Solutions is not responsible for deficiency in service (if any) provided by the professional.
• I understand that the Indian Food Solutions has no control whatsoever over the data or service provided by the professional to me.
• I understand that Indian Food Solutions is merely acting as the payment facilitator between me and the professional.

Intermediary Role

I understand that Indian Food Solutions is acting as an Intermediary between the customer/client and the professional. The relation of consumer and professional etc, by whatever name called, shall be solely between the professional and myself.

In the transaction between the Professional and myself, Indian Food Solutions shall not be responsible for any defect in services provided by the Professional. Indian Food Solutions shall not be deemed to be a party in respect of any such Transaction. Any and all disputes, between Professional and myself in respect of any services provided by Professional shall not require Indian Food Solutions to be a party to any such dispute.

Professional Responsibility

The professional shall be solely responsible for all customer service issues. It is the responsibility of the professional and not the Indian Food Solutions to resolve any dispute or claim raised by customer/client relating to the services provided by the professional.

Legal Proceedings

I will not make Indian Food Solutions or any of its Directors, staff etc party to any proceeding filed or to be filed either by me against the professional or filed by the professional for me since there will be no privity of contract between Indian Food Solutions and myself and between the professional and Indian Food Solutions.

The listing of name and other details of professional by Indian Food Solutions on its website does not constitute or imply endorsement, sponsorship or recommendation of professional, or its service, advice, information provider by listed or its affiliates.

Payment Terms

• The fees chargeable will be collected by the Indian Food Solutions for and on behalf of the professional through any banking mode only like, RTGS/NEFT/IMPS or Bhimpay, Google Pay or Paytm or using any other Unified Payments Interface (UPI) as permitted by RBI.
• No payment shall be accepted in cash or in cheque.
• The fees will be collected prior to the customer/client is referred to the professional.

Governing Law and Dispute Resolution

These Terms will be governed by and construed in accordance with the Indian laws. If for any reason a court of competent jurisdiction finds any provision or portion of the Terms to be unenforceable, the remainder of the Terms will continue in full force and effect.

In case of any dispute between the parties arising of the present terms of usage shall be first tried to be resolved amicably within a period of 30 days from the date of arising of such dispute. Failing which the dispute shall be referred to a sole arbitrator appointed by both the parties jointly. In case both the parties do not agree to the name of arbitrator, then the name of arbitrator as proposed by the Lister shall be final. The arbitration shall be governed by the provisions of Arbitration and Conciliation Act, 1996 as amended till date. The place of arbitration shall be Ahmedabad, Gujarat, India and the language of the Arbitration shall be English.

It is mutually agreed between the parties hereto that any dispute or claim arising under this Agreement shall be subject to the jurisdiction of the Courts at Ahmedabad, Gujarat, India.

Definitions

• The words "I", "me" and "myself" shall be deemed to be mean and used for individual/s or company/ies, or any entity/ies whether registered or not, a person or not, an individual/s or partnership firm/s or LLP/s or Single person company/ies or proprietorship firm/s etc. the above terms are not limited to terms mentioned.
• The word "professional" shall mean an individual professional, more than one professional or his's/her's/their's firm, organisation, partners etc.
• The word "he" shall mean and include his, she, her, it, their etc or other pronouns.
